User / Customer — an entity using the Website, for the benefit of whom electronic services may be provided, or with whom an agreement for the provision of electronic services may be concluded.
Consumer — a User who is an adult natural person ordering products on the Website, acting for purposes outside their trade, business, craft, or profession.
Entrepreneur-Consumer — a natural person conducting business activity who makes a purchase related to their business but not having a professional character, entitled to consumer rights.
Service / Website — the online store at fitcareshop.com, operated by the Operator.
Account — access to the Website functionalities granted after registration. Creation of an Account is tantamount to conclusion of an agreement for electronic services.
Order — a correctly completed order form submitted by the Customer through the Website.
Product — any item available for purchase in the Store.
Sender / Shipper — an entity that has products and can execute the order. The Operator acts as authorized distributor of the brands on the Website.
Carrier (Courier) — an entrepreneur providing transportation services. Available Carriers:
Shipment — a registered, properly packaged item bearing a waybill, delivered in accordance with these Terms and Carrier regulations.
Payment Gateway — Saferpay (SIX Payment Services AG), a PCI-DSS certified payment platform.
GDPR — Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data.
2.1. On the basis of Article 8(1)(1) of the Polish Act of 18 July 2002 on the provision of services by electronic means, Payment Provider Sp. z o.o. establishes the terms for the provision of services by electronic means.
2.2. These Terms govern services provided through fitcareshop.com operated by the Operator.
2.3. The Website may be used by individuals, legal entities, or organizational units granted legal capacity.
2.4. Logging in or ordering requires reading and accepting these Terms.
2.5. The User accepts the transfer of personal data to the Shipper and Carrier for order fulfillment.
2.6. The User agrees that the Operator may process Personal Data provided during registration and use. Provision is voluntary; however, failure to consent may prevent Services.
2.7. The User declares that personal data provided is true and accurate.
2.8. The Carrier's Terms and Conditions are an integral part of the Service.
3.1. Registration and Account creation is free of charge.
3.2. To create an Account, complete the registration form with a valid email and password.
3.3. Account creation confirmation constitutes conclusion of an agreement for electronic services.
3.4. The Operator may refuse Account creation if data indicates false information.
3.5. The User must keep credentials confidential. In case of suspected unauthorized access, change password and notify the Operator immediately.
3.6. The User may cancel Account at any time, equivalent to termination of the contract.
3.7. Ordering is also available without registration, subject to acceptance of these Terms.
3.8. The Operator may block Accounts that violate these Terms.
4.1. Orders are accepted 24/7 through the Website.
4.2. Clicking "Place Order" constitutes a binding Order and acceptance of these Terms.
4.3. The Customer agrees to pay the total amount including shipping costs.
4.4. Order documents are provided electronically and via email.
4.5. The Carrier may contact the Customer to facilitate delivery.
4.6. If an order cannot be executed due to unavailability, the Operator will issue a full refund.
4.7. Orders not yet shipped may be cancelled via office@fitcareshop.com.
5.1. Prices are in EUR (€) and include VAT where applicable.
5.2. The Operator reserves the right to change prices. Changes do not affect confirmed Orders.
5.3. Free shipping for orders over EUR 110.00.
5.4. Payment via Saferpay (PCI-DSS certified). The Operator does not store card numbers.
5.5. Available: Visa, Mastercard, Maestro, online bank transfers.
5.6. VAT invoices issued upon request in accordance with applicable law.
5.7. Refunds use the same payment method as the original transaction.
6.1. Shipped within 1–3 business days after payment confirmation.
6.2. Available: Poland (GLS/UPS courier, InPost Parcel Lockers, COD), UK (Royal Mail), EU courier, worldwide courier.
6.3. Free shipping over EUR 110.00.
6.4. Risk passes to Consumer upon delivery; to business Customers upon Carrier handover.
6.5. The Operator is not liable for Carrier delays, customs, force majeure, or incorrect Customer data.
7.1. The Operator is liable only for normal consequences of acts or omissions causing damage.
7.2. Not liable for: Carrier performance, unauthorized use, system interruptions, payment delays, or loss/damage from Customer causes or force majeure.
7.3. Maximum liability shall not exceed the amount paid for the specific Product.
7.4. Nothing excludes liability that cannot be excluded by law.
8.1. Supplements are not intended to diagnose, treat, cure, or prevent disease. Consult a healthcare professional.
8.2. Research compounds, peptides, SARMS are for in-vitro research and laboratory use only. NOT for human consumption.
8.3. Compression systems (PSR Recovery) are Class 2a medical devices. Follow manufacturer instructions.
8.4. The Customer assumes full responsibility for lawful use in their jurisdiction.

9.2. Processed per GDPR and Polish data protection law.
9.3. Collected: name, address, phone, email, NIP (business), bank account (refunds).
9.4. Legal basis: contract performance (Art. 6(1)(b)), legal obligations (Art. 6(1)(c)), legitimate interests (Art. 6(1)(f)), consent (Art. 6(1)(a)).
9.5. Recipients: Carriers, payment operators, accounting, IT providers, authorities.
9.6. Rights: access, rectification, deletion, restriction, portability, objection, complaint to Prezes UODO.

10.1. The Website uses cookies for proper operation and analytics (Google Analytics).
10.2. Types: statistical, functional, security, advertising.
10.3. Users may manage cookies via browser settings. See Cookie Policy.
11.1. Consumer and Entrepreneur-Consumer may withdraw within 14 days of receiving the Product, without reason.
11.2. Send withdrawal statement to office@fitcareshop.com. Model form (Appendix 2) may be used.
11.3. Return to: Payment Provider Sp. z o.o., ul. Opolska 15, 40-084 Katowice, Poland.
11.4. Return within 14 days; return shipping cost borne by Consumer.
11.5. Refund within 14 days using same payment method.
11.6. Exceptions: sealed products opened after delivery (supplements), perishable goods, custom products (NW costumes), fully performed services.
12.1. Submit within 14 days of receiving goods to office@fitcareshop.com or by post.
12.2. Include: contact details, order number, defect description, preferred resolution.
12.3. Processed within 14 days. Resolution: repair, replacement, price reduction, or refund.
12.4. Transport complaints forwarded to Carrier per their regulations.
12.5. Complaints are free of charge.
13.1. Available: permanent amicable consumer courts, Provincial Inspector of Commercial Inspection, consumer ombudsmen.
13.2. EU ODR platform: ec.europa.eu/consumers/odr
14.1. SSL encryption for all communications.
14.2. Internet use carries inherent risks (spam, malware, phishing).
14.3. Users should use strong passwords, log out after sessions, and keep credentials confidential.
15.1. All Website content is the Operator's property, protected by copyright and trademark law.
15.2. Reproduction without written consent is prohibited.
16.1. Not liable for failures from natural disasters, pandemics, war, government actions, supply chain disruptions, or Carrier failures.
17.1. The Operator may amend Terms at any time. Changes effective upon publication.
17.2. Orders before amendments governed by Terms at time of Order.
18.1. Invalid provisions do not affect remaining provisions.
19.1. Governed by Polish law, without prejudice to mandatory consumer protection of Customer's country.
19.2. Disputes submitted to courts in Katowice, unless law provides otherwise for Consumers.

You have the right to withdraw within 14 days without giving any reason. To exercise this right, inform Payment Provider Sp. z o.o., ul. Opolska 15, 40-084 Katowice, email: office@fitcareshop.com. The model form (Appendix 2) may be used. To comply, send the communication before the period expires. Refund within 14 days using the same payment method.
